APC allows trucking company to operate

Carroll County Area Plan Commission members voted last year to recommend that county commissioners spotzone a parcel of land just east of Carrollton Road to allow a trucking terminal to continue to operate on the site. Restrictions were recommended by APC for the action.

Commissioners Bill Brown, Pat Clawson and Ron Slavens did not agree with APC and denied the request. The trucking company has not been compliant with the current zoning ordinance since last fall.

The matter was presented again Jan. 24 by zoning administrator Kathy Mylet. She suggested that there was verbiage in the current ordinance that would allow the company to continue to operate on the site.

APC attorney Cindy Harmon advised that, although the section of the ordinance that Mylet suggested be used was not applicable to the situation, APC could consider the activities of the trucking company to be “agriculture related activities” which is a permitted use in an agricultural zoning area.

Harmon said if the group agreed that the business is “agrelated,” neighbors will have to complain about the size or the nature of the business to initiate a change with APC.

The definition of “agriculture” in the current zoning ordinance is: “The use of a tract of land for agricultural purposes, including farming, dairying, pasturage, apiculture, horticulture, floriculture, viticulture and animal and poultry husbandry and treating or storing the produce; provided however that the operation of any such accessory uses shall be secondary to that of the normal agricultural activities.”

The matter was tabled to allow the JBA Logistics owner and neighbors to comment on the issue at the next meeting. Other business

2012 officers were elected. Kirk Germond was retained as president and Bob McCain as vice president. Mylet was appointed secretary to the group and Harmon was retained as legal counsel. Compensatory time for the zoning administrator was approved.

New members Don Frushour, who is appointed by the county council, Pat Baker, appointed by the Camden Town Council, and John Bennett, appointed by the Delphi City Council, were recognized. Returning members are county surveyor Wayne Chapman, Germond, McCain, county extension agent Andrea Brown, Burlington Town Council appointee Joe Armstrong and commissioners’ appointment Fred Wise.

The next meeting will be Feb. 28 at 7 p.m.
