Lohmiller trial continued
Lohmiller The trial of a former employee of the county health department, charged with practicing nursing without a license and fraud, will continue to be unresolved for several more months.
A motion to continue by Rebecca Lohmiller's attorney Anne Briggs, was granted by Special Judge Linley E. Pearson in a telephone pre-trial conference. The basis of the request was due to Lohmiller's health concerns.
Stating that evidence is documented and "frozen in time," Carroll County Prosecuting Attorney Rob Ives said the continuance was not a concern for his office.
According to a probable cause affidavit filed Aug. 3, 2005, in Carroll Circuit Court, Lohmiller is charged with six counts of forgery, a class C felony, and 21 counts of practicing nursing without a license, which are misdemeanor charges.
A C-felony carries the penalty of between two to eight years and a B-misdemeanor carries a penalty up to six months.
Lohmiller's county employment record indicated she was employed as a part-time county health nurse from Nov. 8, 1999, until March 31, 2001. She was hired as the full-time county health nurse on April 1, 2001, and resigned as of Oct. 1, 2004.
The next court action scheduled is a pre-trial telephone conference on Dec. 11 with Judge Pearson. The trial is set for Jan. 9 -11, 2007.
